**Service Agreement**

This Service Agreement ("Agreement") is entered into on the effective date mentioned above, by and between Winkler Mechanical LLC ("Service Provider") and [Customer's Name] ("Customer").

**1. Services:**

1.1 Service Provider agrees to provide handyman services as requested by the Customer.

1.2 A standard service fee of $150 will apply to each visit, covering assessment and providing a quote.

1.3 Labor will be charged at an hourly rate of $50, billed in 30-minute increments, with a minimum one-hour charge.

**1.4 Cost of Parts and Materials:**

The cost of parts and materials necessary for the completion of the services will include taxes, shipping, and a reasonable markup. These costs will not be itemized separately but will be incorporated into the overall project cost.

**1.5 Pricing Structure:**

Not every job will be charged hourly. The pricing for certain projects will be determined based on the necessary skill set required and will be presented as an entire project cost. This pricing approach ensures a fair assessment of the complexity and requirements of each job.

**2. Asbestos and Hazardous Materials:**

The Service Provider is not responsible for addressing or handling asbestos or other hazardous materials. In the event that asbestos or other hazardous materials are encountered during the course of the project, it is the Customer's responsibility to engage the services of a qualified specialist for safe removal and disposal. A valid certificate of asbestos abatement, provided by a certified specialist, must be presented to the Service Provider before work in areas potentially containing asbestos can commence.

**3. Scope Changes:**

Any additional tasks or changes in the original project will result in additional fees. Such changes will be discussed and agreed upon by both parties before implementation.

**4. Customer Responsibilities:**

Prior to the Service Provider's arrival, the Customer must ensure that the work area is cleared and safe for service. It is the Customer's responsibility to provide access to the job site and secure any necessary permits. Additionally, the Customer must have payment in full upon completion of the contract.

**5. Dispute Resolution:**

In the event of a dispute arising from this Agreement, both parties agree to seek an amicable resolution through mediation or arbitration. An independent mediator or arbitrator will be jointly selected or appointed to facilitate the resolution process. All costs and fees associated with the dispute, including but not limited to mediation or arbitration costs, attorney's fees, and any court-related expenses, shall be the sole responsibility of the party bringing the dispute against Winkler Mechanical LLC.

**6. Changes and Adjustments:**

These terms and conditions are subject to changes and adjustments. The Service Provider reserves the right to modify this Agreement as needed to comply with legal requirements, industry standards, or for other valid reasons. Customers will be notified of any changes to these terms.

**7. Governing Law:**

This Agreement shall be governed by and construed in accordance with the laws of the State of New Jersey.

**8. Entire Agreement:**

This Agreement constitutes the entire understanding between the Service Provider and the Customer, superseding all prior agreements, whether written or oral.
